The Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) preserve employees’ terms and conditions of employment when a business or part of a business is transferred to a new employer. TUPE is also relevant where a function or activity is outsourced, where there is a switch of contractors responsible for that activity or when the activity or function is taken back in house.
